Court Backs ASPS and ABPS
The ASPS, ABPS, and the Utah Plastic Surgery Society (UPSS) recently achieved a favorable decision in the 10th District U.S. Courts of Appeals in Denver, CO. A lawsuit had been filed earlier against these organizations for running a patient safety education awareness campaign that distinguished qualified plastic surgeons from other surgeons.
That lawsuit was earlier dismissed by a local court, and now the district court has upheld the previous dismissal. The plaintiffs had contended that the awareness campaign of these organizations led to a loss of business for non-plastic surgeons. The appellate court upheld the dismissal of this complaint, signifying an important victory for organized and certified plastic surgery.
The ASPS had launched a critically important ‘Do Your Homework’ public education campaign to encourage potential patients to obtain proper knowledge about the qualifications of a plastic surgeon before going ahead with a procedure.
